Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed through kittyclubclothing.com, operated by Paul Bojer, trading as Kittyclub, Gelsenkirchener Straße 14, 44866 Bochum, Germany ("Seller"), with consumers ("Customer") within Germany.

 

2. Contracting Party and Conclusion of Contract

The contract is concluded with Paul Bojer (Kittyclub). Product listings do not constitute a binding offer; they are an invitation for the Customer to place an order. By completing checkout, the Customer submits a binding offer to purchase. The contract is concluded when the Seller confirms the order by email.

 

3. Prices and Payment

All prices are shown in EUR. As the Seller applies the small business regulation (§ 19 UStG), no VAT is separately shown or charged. Accepted payment methods: credit/debit card, PayPal, and Shop Pay.

4. Delivery

Products are made to order. Estimated delivery times are stated in our Shipping Policy. These are estimates, not guaranteed delivery dates, unless explicitly stated otherwise.

 

5. Right of Withdrawal

Consumers have a statutory right of withdrawal as described in our Return and Refund Policy.

 

6. Retention of Title

Delivered goods remain the property of the Seller until paid for in full.

 

7. Warranty

Statutory warranty rights (Gewährleistung) apply. In case of defects, the Customer may contact us at kittyclub.clo@gmail.com.

 

8. Liability

The Seller is liable without limitation for damages resulting from injury to life, body, or health, and for damages caused by intent or gross negligence. For slightly negligent breaches of material contractual obligations, liability is limited to foreseeable, typically occurring damage. Further liability is excluded.

 

9. Online Dispute Resolution

10. Alternative Dispute Resolution (§ 36 VSBG)

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

 

11. Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). This does not affect mandatory consumer protection provisions of the Customer's country of residence.
